By using Obsydia Retail, you agree to these Terms of Service.
Services and estimates
Obsydia builds custom mini servers and installs the services you choose. Estimates and quotes are informational until confirmed in writing. Pricing, timelines, and availability may change based on hardware and requirements.
Bring your own device (BYOD)
If you provide your own hardware, you confirm it meets at least 8 GB RAM and has enough storage for the GB you expect to use. You are responsible for hardware condition and compatibility.
Data and backups
You are solely responsible for your data and backups. Data loss can occur due to hardware failure, power issues, software bugs, or user error. You should maintain independent backups.
Third-party software and services
We may use or install third-party and open-source software. Those providers are not controlled by Obsydia and their terms and availability apply.
Use of software and content
This site and the services offered consist of hardware sales and/or configuring customer equipment with open-source software for legitimate purposes such as personal libraries, backups, private storage, and streaming within private networks. We do not sell, distribute, host, or provide copyrighted media. You are solely responsible for any content you add, download, access, share, or transmit, and you agree to comply with applicable laws and third-party rights. We do not promote infringement or evasion of paid services. Third-party applications are provided under their respective licenses, and access to third-party resources can change or stop. To the extent permitted by law, the seller is not liable for your use of the equipment/software, including infringement claims, third-party terms violations, data loss, or service interruptions. You should use only content you own, are licensed to use, is public domain, or you have express permission to use. By purchasing or contracting, you accept these terms.
Security, network, and environment
You are responsible for your network, power, physical security, and safe use of the system. Obsydia is not responsible for outages, ISP issues, power events, malware, or unauthorized access.
External storage
External hard drives can be added when supported by the selected service or application. Compatibility and performance are not guaranteed.
No warranties
Services are provided "as is" without warranties of any kind, including uptime, performance, or fitness for a particular purpose.
Limitation of liability
To the maximum extent permitted by law, Obsydia is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, profits, or use, whether in contract, tort, negligence, or strict liability. Liability is limited to the amounts you paid for the service that gave rise to the claim.
Indemnification
You agree to defend, indemnify, and hold Obsydia harmless from claims, damages, losses, liabilities, and expenses (including attorney fees) arising from your use of the services, your content, or your violation of law.
Release and dispute resolution
By using our services, you agree to release and hold Obsydia harmless from claims related to data loss, service interruptions, third-party software, or device issues, and you agree not to pursue legal action or class actions against Obsydia, to the maximum extent permitted by law. Please contact us first to resolve any concerns.
Force majeure
Obsydia is not responsible for delays or failures caused by events beyond our reasonable control, including storms, power outages, supply chain issues, or acts of government.
Changes to these terms
We may update these terms from time to time. Continued use of the site or services constitutes acceptance of the updated terms.
Governing law
These terms are governed by the laws of Puerto Rico and applicable federal laws of the United States.
